These Terms of Service apply to any use of the SKY DUST LiftOFF platform, the skydust.io website and all related services provided by Sky Dust ESG Consulting B.V. (trading as SKY DUST). By creating an account or using our services, you agree to these terms.

Sky Dust ESG Consulting B.V., trading as SKY DUST, is established in Zwolle, The Netherlands, and registered with the Dutch Chamber of Commerce (KvK) under number 86193309.
You can reach us at karlo.timmerman@skydust.io. In these terms, "we", "us" and "SKY DUST" refer to this company. "You" refers to the customer or user of our services.
SKY DUST LiftOFF is an online platform where AI agents prepare recurring work such as email handling, quotes, customer follow-up and administration. You review and approve prepared work before it is executed.
In addition to the platform, we offer custom AI development. Custom projects are governed by the terms agreed in the applicable proposal or statement of work. If there is a conflict, the proposal prevails over these terms.
Our services are intended for business use by companies, self-employed professionals and organisations. By creating an account you confirm that you are acting in the course of a trade or profession and are authorised to bind your organisation.
AI agents rely on AI models. AI can make mistakes, misinterpret information or produce incomplete results. The platform is therefore designed so that you review and approve prepared results before they are used or sent.
Your use of the platform is subject to our Acceptable Use Policy, which among other things prohibits illegal activity, spam, deception and infringement of the rights of others. That policy forms part of these terms.
We work hard to keep the platform available, but cannot guarantee uninterrupted availability. Planned maintenance is announced in advance where possible. Our service and support commitments are described in the Service Level Agreement.
Where the AI agents process personal data of your customers or employees, we act as a processor on your behalf. Our Data Processing Agreement then forms part of the agreement. How we handle personal data of website visitors is described in our Privacy Policy.
We are not bound by our obligations to the extent performance is prevented by force majeure, such as outages at hosting providers or AI vendors, power or internet failures, or government measures. If force majeure lasts longer than 30 days, either party may terminate the agreement for the part not yet performed.
We may update these terms. Material changes are announced at least 30 days in advance by email or via the platform. If you continue to use the service after the effective date, the updated terms apply. If you do not agree, you can cancel before the change takes effect.
These terms are governed by Dutch law. We will first try to resolve disputes together in good faith. If that fails, the competent court in the district of our registered office has jurisdiction, unless mandatory law provides otherwise.
